Dreamsong Music Lab Policy

Welcome to Dreamsong Music Lab. We are excited for your child to join our community. We hope you enjoy your music lessons and make some serious musical progress! Before enrolling in Dreamsong Music Lab, we require the student or the parent of the student (the student and parent) to read and agree to the following Student Enrollment Agreement (Agreement). If you are registering an adult student for lessons, references to "parent" in this Agreement are inapplicable. The parent is registering a minor student. The adult student is registering for themselves. The word "student" is understood to apply to all "members" at DSML as well. 

We are happy to meet at a conjunction with our Lesson Policy and Privacy Policy to fulfill all of your educational and privacy needs, all updated from time to time, are incorporated into this Agreement. Please read the Lesson Policy and Privacy Policy carefully before agreeing to this Agreement.

I. Lessons, Classes, and Services

Dreamsong Music Lab provides lessons, including one-on-one instruction, classes or lesson instruction for which you sign up, sessions, and services as an in-person, one-on-one instruction, classes, group sessions, or we are referred to, collectively, our Services. Your Services will include the designated amount of instruction time and any performances or recitals, including the attendant services that we do for your benefit or for a particular service. You agree to pay for that Service or all such Services.

When you register for lessons or classes, you agree to attend all lessons and classes, pay for the lessons and classes, and agree to arrive on time. We reserve the right to cancel lessons and classes, reschedule lessons and classes, and change lesson or class schedules, instructors, or other similar issues. We will always do our best to accommodate your Services within the reasonable bounds of the situation, including working to minimize changes, engaging a substitute instructor for you, extending the time for a Service, or rescheduling. We will always notify you as soon as feasible of any change.

II. Student Responsibilities

It is the student's responsibility to show up to lessons or classes, be prepared, and with all necessary equipment. If a student is running late, the student must contact Dreamsong Music Lab, who will inform the instructor. Students will not be permitted to stay late to make up for lost time, as this will negatively impact other students and instructors.

The student is responsible for acquiring and maintaining their musical equipment, instrument, score and sheet music, and any other equipment required for the lessons. These will not be provided by Dreamsong Music Lab. Students need to have or purchase an instrument or musical tools (e.g., sheet music) to pursue the lesson. We do have 4 keyboards for use during class time and reservable office hours, along with one reservable computer/software space. 

The student is responsible for promptly providing Dreamsong Music Lab with accurate contact information and emergency contact information, and for providing notice to Dreamsong Music Lab for any change in contact information. For children, Dreamsong Music Lab may not use more than is necessary to reach them at a necessary contact form.

The student must be respectful and cooperative with all instructors, staff, and other students. The student will treat all Dreamsong Music Lab property, equipment, and facilities with care and respect.

The student is responsible for all misconduct and damage and will be banned from the school, and Dreamsong Music Lab and the student may agree to a mutually amicable and culturally diverse space that strives to be a safe and inclusive space for all who aspire to learn. Students will take away from the safe, inclusive, and respectful nature of the school where they are to learn.

The student is responsible for practicing and preparing. The student agrees to practice as instructed and inform their instructor of activities that may prevent such practicing in a timely manner.

III. Costs and Payment

The payment for the lessons is based on the provided Dreamsong Music Lab fee structure and is due upon time to time. These classes and lessons are paid for at the time of registration, or at the beginning of each payment cycle. The student is responsible for paying for the upcoming month of the upcoming month or the liability of extending and keeping up to date (when payment information changes, late fees of $10.00 will be due) or any necessary late payments or misuse of a forfeiture process. A forfeiture process may be implemented for attending further Services, if payment is more than three days after the due date.

DSML reserves the right to change our prices at any time, with 90-day notification to all recurring members.

A forfeiture process may be enforced by Dreamsong Music Lab if payment is not received on time or if there is a problem with the payment method or if the student has a history of late payments. A forfeiture process includes, but is not limited to, a suspension or discontinuation of the Service at the beginning or an endnote to the service until the amount due is paid, and the student may not be permitted to register for further services until the amount due is paid. A forfeiture process will be enforced until payment is made in full, which will include the full amount due, plus any fees or charges.

Dreamsong Music Lab will not provide refunds for classes missed, nor rescheduling. All lessons will be charged for at the time of the monthly payment schedule, or registration. Students who cancel or terminate their lessons until payment is made and/or a forfeiture process is enforced, will be charged for the full monthly payment. They will continue to have full access to their services until the end of that payment cycle. 

The student must pay all costs and expenses.

IV. Termination

This agreement shall be effective during the duration of student enrollment. It shall apply to any classes taken by a student during that time.

Students may terminate this Agreement at any time by notifying in writing or in person of their current classes taken. If using recurring payments, student must cancel the membership at least 24 hours in advance of the recurring payment date. If a membership is cancelled, student will have full access to their membership for the remainder of that payment term. Example: a student enrolls in recurring payments on the 12th of any month. Their recurring payment will occur on the 12th of each month. If, later on, they cancel their membership on the 22nd of a month, they will have continued access to their DSML services until the 12th of the following month.  

Dreamsong Music Lab may terminate this Agreement at any time by notifying in writing or a verbal notice to the student. If the termination is in the best interest of Dreamsong Music Lab, a violation of any terms of this policy, or the student's external or internally harmful behavior towards Dreamsong Music Lab, it will be effective immediately. If the student can not or will not refrain or adhere to the agreement or any other reason, as often as effective rather than the student or in the best interest of the student or for any reason of the student that has not been known.

V. Marketing, Videos, and Photos

The student agrees to allow Dreamsong Music Lab to take photos or videos of the student while attending classes or lessons. The student agrees Dreamsong Music Lab may use those photos for marketing purposes, including brochures, social media, websites, and other marketing materials. Dreamsong Music Lab agrees not to use those videos or photos for any reason other than marketing purposes without the student's explicit written consent (e.g., no endorsement or sponsorship).

VI. Recordings

The student agrees all works, compositions and performances that Dreamsong Music Lab provides to the student in the lesson time, if the student is writing a song, a simple rhythm, or is doing a thing that is provided by a student or a sole author and more.

The student agrees all works, compositions and performances, or recordings, or records, performs while at Dreamsong Music Lab to Dreamsong Music Lab to be the owner for purposes of advertising, marketing, and the proceeds and the revenues and the indicators. This license shall be perpetual and non-exclusive. The student agrees that the services it receives from Dreamsong Music Lab are unique and valuable consideration for this license.

VII. Waiver and Indemnification

The student understands that all activities at Dreamsong Music Lab are not inherently dangerous, but that an accident or injury may still occur. In order to avoid risk, the student understands that it is a sole responsibility to follow all instructions given to the student, not to perform any actions that may cause damage to the student, their instrument, or other students, and to avoid unnecessary risks. The student will take all reasonable precautions to minimize risks, including following all instructions.

The student EXPRESSLY RELEASES AND FOREVER DISCHARGES Dreamsong Music Lab, ITS OFFICERS, DIRECTORS, AND REPRESENTATIVES OF ALL CLAIMS, LIABILITIES, DAMAGES, COSTS, OR OTHER CAUSES OF ACTION THAT MAY ARISE OUT OF ANY RELATED CLASSES AT Dreamsong Music Lab DUE TO MY OR THEIR THIRD PARTY NEGLIGENCE, CARELESSNESS, DEGREES, DEFECTIVE EQUIPMENT, DEFECTIVE INSTRUCTIONS, ACTS OR OMISSIONS, OR OTHER CLAIMS.

VIII. No Guarantees and Waiver of Damages

The student acknowledges and agrees that Dreamsong Music Lab makes no guarantees as to musical talent, improvement, ability, or otherwise gain from classes or lessons taken at Dreamsong Music Lab.

The student KNOWS AND ALL DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL DAMAGES AND LOSS OF PROFIT, DISRUPTIONS, OR EXCESSIVE AMOUNT OF MONEY PAID FOR CLASSES.

IX. Dispute Resolution

Dreamsong Music Lab requests that if any issue with the instructor, any fees, students, initiation, safety, or the school, that the student inform Dreamsong Music Lab as soon as possible as a verbal or written communication of the reason you are dissatisfied or the nature of the issue. Dreamsong Music Lab will respond to your complaint within five (5) business days and will work diligently to resolve the issue to your satisfaction. If Dreamsong Music Lab and the student cannot resolve the issue, and the issue is not related to a termination, Dreamsong Music Lab will provide the student with the option of mediation and arbitration to resolve the dispute. The student and Dreamsong Music Lab agree to submit all claims related to this Agreement to the American Arbitration Association for the dispute resolution process and will agree to investigate the issue and attempt to resolve it in the best judgment.

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in Seattle, WA. The parties consent to the exclusive venue of the courts in Seattle, WA for any action or proceeding arising out of or relating to this Agreement. The parties forever waive any right that they may have to a jury trial. The parties agree that the prevailing party will be entitled to reasonable costs and attorneys' fees.

I agree to all the above paragraph on my own behalf. I agree to the Privacy Policy and I agree to the Lesson Policy and I agree to the Agreement.
